The article is based on a study of all habeas corpus petitions of the Supreme Court in preventive detention cases in a 20-year time frame.

The report is a collated analysis of all habeas corpus petitions in preventive detention matters in the Supreme Court of India from 2000-2019. The author has broadly characterized the analysis into three parts: a) the total time spent between the date of the detention order and date of final disposal by the Supreme Court b) the secluded time at the Supreme Court c) the time spent in actual detention before final disposal by the Supreme Court. Based on the characterization, the author answers several critical questions involving the concatenation of preventive detention and personal liberty, and the constitutional safeguards thereto.
